Who can apply for letters of administration?

According to statute law, the spouse of the deceased is first entitled to make such application through her attorney-at-law.

If the deceased dies without spouse then the children of the deceased could make the necessary application.

If there is no spouse or children surviving the deceased. Then the parents are entitled, then the siblings of whole blood.

The law continues to state the order of the persons entitled to apply.

Where the deceased was common law, subject to certain provisions, the common law spouse must make a special application before the High Court Family Court division.
